Job Description

ABOUT THE POSITION

The Clark County District Attorney's Civil Division is seeking qualified candidates to apply for the Attorney position. The Civil Division provides professional legal guidance and support for elected officials, Clark County departments, and boards as they conduct the business of Clark County. The department represents the County before judicial and administrative agencies in civil litigation proceedings; furnishes legal advice and opinions; drafts and reviews contracts and other legal documents; initiates legal action; interprets law. The Attorney position is an experienced working level position in the Civil Division. Attorneys are assigned County departments and are expected to perform a wider range of assignments with greater independence and minimal guidance or supervision. Attorneys perform complex legal work related to civil matters and provide legal advice and counsel to anticipate, avoid, or resolve potential or pending legal issues, disputes, and litigation; and performs related duties as assigned.

This examination will establish an Open Competitive Eligibility list to fill current and/or future vacancies that may occur within the next six (6) months or may be extended as needed by Human Resources.

MINIMUM REQUIREMENTS

Education and Experience: Possession of a certificate of admission to the Bar of the State of Nevada and eligibility to practice law before the courts of the State of Nevada, AND two (2) years of full-time experience in professional legal work as a practicing attorney.

Background Investigation: Employment is contingent upon successful completion of a background investigation. Periodically after employment background investigations may be conducted.

EXAMPLES OF DUTIES

Incumbents handle the more complex misdemeanor criminal cases, felonies, and civil cases. Interviews and counsels complainants and witnesses in regard to prospective criminal or civil action. Prepares and presents State's evidence in criminal actions to include legal arguments regarding merit; argues on behalf of the State against writs of habeas corpus, petitions for pos-conviction relief and motions to suppress evidence. Appears on behalf of the State in probation, revocation hearings and sanity hearings; prepares and supervises the preparation of legal briefs filed on behalf of the State. Presents plea negotiations with opposing attorneys. Conducts pre-trial interviews with victims, defense attorneys and arresting officers relative to the violation of statutes and the filing of complaints. Prepares cases for trial; presents plea negotiations with opposing attorneys. Confers with investigators regarding the collection of facts and evidence. Prepares legal pleadings, such as complaints, answers, writs, discovery and judgments; attends preliminary hearings and trials and prosecutes a variety of cases before County and State courts. Prosecutes cases involving sexual assault, child molestation, child abuse, domestic violence and other complex and sensitive cases. Confers with and advises County officials, employees, department heads, and representatives on legal questions; renders legal opinions; drafts ordinances, resolutions and other legislative measures; represents the County in hearings and on cases initiated by or against the County.

In the Public Defender's/Special Public Defender's Office, incumbents are assigned to handle complex gross misdemeanor, felony criminal and juvenile cases assigned to the Public Defender. Investigates cases; interviews and counsels indigent defendants and witnesses; may visit crime scenes, jails, and case related sites; attend pre-trial line-ups. Obtains documents by subpoena and other discovery methods. Negotiates with prosecutors, probation officers and judges regarding the disposition or modification of charges. Orders investigations; confers with investigators to monitor progress of investigation; interviews defendants and witnesses; prepares for trial, and conducts trial defense of indigent juveniles and adults; appears with and for defendants at court hearings. Researches, prepares, files, presents and argues motions; Attends pre-trial police lineups; attends arraignments, preliminary hearings, hearings and trials and defends indigent clients in a variety of cases before County or State courts. Advise clients on settlement offers, options, and potential for success at trial or other dispositions of cases.

Conducts legal research and performs various studies; interprets and applies laws, court decisions and legal points and authorities for use in the preparation of cases, opinions and briefs for the prosecution or the defense. Prepares legal pleadings such as complaints, answers, writs, demurrers, discovery and judgments; attends preliminary hearings and trials and prosecutes or defends a variety of cases before County and State courts; dictates legal instruments, correspondence and reports. When assigned to Juvenile, coordinate juvenile prosecution, works closely with policy, school officials, community groups, treatment programs, probation officers and the Courts. May be involved in handling prosecution or defense in cases involving sexual assault, child molestation, child abuse and/or domestic violence. Contributes to the efficiency and effectiveness of the unit's service to its customers by offering suggestions and participating as an active member of a work team. Maintains accurate records and files; prepares a variety of records and reports as assigned. May assist Senior Attorney in the handling of capital punishment or other high profile cases. May provide training and instruction to Associate Attorneys. Uses standard office equipment, including a computer in the performance of the work. May drive a personal or County vehicle in the course of the work or be capable of arranging for transportation to off-site locations in order to attend meetings and conduct other legal business.
