Job Description and Duties Do you want to work as a criminal prosecutor as part of a dynamic vertical prosecution team? We are seeking an experienced criminal prosecutor to join our team in the Division of Medi-Cal Fraud and Elder Abuse (DMFEA), in our Riverside Regional Office. This position is part of a vertical prosecution unit, in which the criminal prosecutors work closely with members of their partner disciplines, such as DMFEA special agents, investigative auditors and crime analysts. The DAG advises and collaborates with agents, auditors and analysts on criminal cases; jointly develops investigative plans; reviews reports, search and arrest warrants; and, makes filing decisions for criminal charges. The DAG’s tasks include legal research and writing, regular appearances in state courts, from case filing to sentencing, and, the presentation of evidence at various hearings, grand juries and trials. Additional duties may include prosecuting crimes involving drug diversion of opioids and other controlled substances; cooperating with partner agencies tasked with the administration and regulation of the Medi-Cal programs and residential care facilities; collaborating with healthcare professionals and experts, such as experts on standards of care, computer and forensic experts, money laundering and asset freeze and forfeiture experts; and, liaising with federal, state and local law enforcement partners, as well as out-of-state law enforcement agencies and Attorney General Offices. Job Description and Duties The Division of Medi-Cal Fraud and Elder Abuse (DMFEA) investigates and prosecutes, both criminally and civilly, healthcare providers who defraud the Medi-Cal program and those who abuse or neglect elderly and dependent adults in care facilities. Within DMFEA, the Facilities Enforcement Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other long term care facilities by prosecuting allegations involving systemic fraud, abuse, and neglect in criminal and civil state court actions. As a member of the Facilities Enforcement Team, this Deputy Attorney General position is part of a vertical prosecution unit where prosecutors work closely with the Division’s special agents and investigative auditors, advising on the development of investigative plans, reviewing search warrants and arrest warrants, and determining whether to file a criminal or civil enforcement action. The DAG then litigates the criminal or civil prosecution from filing to conviction and sentencing or settlement. The unit emphasizes the critical work of establishing criminal and civil liability of owners, operators, and controlling entities of adult residential care facilities, including corporate liability for business practices that risk or cause harm to residents (Business & Professions section 17200). The DAG is expected to perform a variety of complex legal and other research, and stay up to date in the rapidly changing fields of health care law, elder law, and electronic evidence. The DAG will work collaboratively with multi-disciplinary teams of nurses, doctors, auditors, special agents, and others in conducting investigations and litigating cases, and will also work with regulatory and executive agencies which may take administrative actions concurrent with our investigations. Evaluates facility records and other evidence and recommends enforcement proceedings such as criminal prosecutions, citations, injunctions, decertification or the revocation of facility licenses in accordance with established policies and procedures. Reviews and evaluates team effectiveness and takes necessary steps to assure that current laws, regulations, policies and procedures are consistently followed. Reviews, evaluates, and signs correspondence concerning violations and compliance with State, Federal, and local laws and regulations. Plans and provides in-service training through the development of training programs and workshops in cooperation with State and Federal training coordinators. Reviews, evaluates, and recommends changes to plans and proposals for new construction of, or for changes and alterations to, health care facilities. Maintains production records and statistical data to aid in monitoring activities of subordinate staff. Presides at District staff and training meetings and quarterly provider group meetings. Conducts special internal and external studies, analyzing issues, recommending solutions and assisting in the implementation of approved changes. May meet with community groups regarding Division functions and the regulation process.
