Job Description and Duties This is an opportunity to work in the newest Division of the Department of Justice, the Division of Medi-Cal Fraud and Elder Abuse (DMFEA). A Deputy Attorney General (DAG) in DMFEA performs complex legal work investigating and litigating cases of violations of the state False Claims Act (FCA), as well as other cases involving Medi-Cal fraud (i.e., fraud by providers and other entities at the expense of Medi-Cal, California's Medicaid program). The duties of this DMFEA DAG position include: developing strategic case plans; managing and developing investigations; handling discovery professionally and effectively; identifying and evaluating witnesses; performing challenging legal research in the areas of health care fraud and False Claims Act law, and communicating results thereof with effective writing and oral skills; and, coordinating efforts with other states' Attorney Generals' offices and U.S. Attorney's Offices in joint investigations and actions. The DAG also coordinates work with DMFEA paralegals and DMFEA Investigative Auditors at all stages of investigations and litigation. The DAG effectively manages document-intensive cases. Experience in and/or knowledge of health care fraud, the health care industry, the Medi-Cal Program, False Claims Act litigation (state or federal), and the pharmaceutical industry is helpful but not required. A successful applicant would be assigned their own caseload, but would be a member of a small team of attorneys, paralegals and secretaries and would interact with their team regularly. Job Description and Duties Under the direction of the Special Agent In-Charge, the Special Agent Supervisor is responsible for supervising and directing a team of Special Agents in Medi-Cal provider fraud, patient abuse, and drug diversion investigations. Specific duties include planning, assigning, and directing criminal, civil, and special investigations; organizing and conducting the more difficult, complex, or sensitive investigations; reviewing time and task accounting systems, ProLaw database updates, investigative reports, and search and arrest warrant affidavits. Serve search and arrest warrants and conduct covert and surveillance operations. Responsible for coordinating the casework of team members with the assigned DAG and Investigative Auditor. Job Description and Duties The Division of Medi-Cal Fraud and Elder Abuse (DMFEA) investigates and prosecutes, both criminally and civilly, healthcare providers who defraud the Medi-Cal program and those who abuse or neglect elderly and dependent adults in care facilities. Within DMFEA, the Facilities Enforcement Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other long term care facilities by prosecuting allegations involving systemic fraud, abuse, and neglect in criminal and civil state court actions. As a member of the Facilities Enforcement Team, this Deputy Attorney General position is part of a vertical prosecution unit where prosecutors work closely with the Division’s special agents and investigative auditors, advising on the development of investigative plans, reviewing search warrants and arrest warrants, and determining whether to file a criminal or civil enforcement action. The DAG then litigates the criminal or civil prosecution from filing to conviction and sentencing or settlement. The unit emphasizes the critical work of establishing criminal and civil liability of owners, operators, and controlling entities of adult residential care facilities, including corporate liability for business practices that risk or cause harm to residents (Business & Professions section 17200). The DAG is expected to perform a variety of complex legal and other research, and stay up to date in the rapidly changing fields of health care law, elder law, and electronic evidence. Job Description and Duties The Division of Medi-Cal Fraud and Elder Abuse (DMFEA) investigates and prosecutes, both criminally and civilly, healthcare providers who defraud the Medi-Cal program and those who abuse or neglect elderly and dependent adults in care facilities. Within DMFEA, the Facilities Enforcement Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other long term care facilities by prosecuting allegations involving systemic fraud, abuse, and neglect in criminal and civil state court actions.
