    at the pleasure of the Nevada Health Authority Director.
    Approximate Annual Salary
    Up to $151,108 plus benefits * (Salary range reflects retirement (PERS) contributions by both the employee and
    employer. An employer paid contribution plan is also available with a reduced gross salary.)
    Benefits

    Position Summary
    The Nevada Health Authority General Counsel provides legal support of the Nevada Health Authority (NVHA). This
    includes supporting the Director, Administrators and Deputy Directors with respect to the Department's purchasing
    process for procuring and negotiating health care coverage on behalf of Nevadans served by the Department,
    reviewing and analyzing complex federal laws and regulations in support of the programs administered by the
    Department, developing Departmental policies and protocols to ensure compliance with state and federal
    requirements for all programs, coordinating and consulting with the Department's assigned Deputy Attorney
    General(s) on current legal matters and any issues that could result in litigation for the Department, and other state
    requirements affecting fraud, waste and abuse and licensing activities for the Department.

    Reporting to the Director of Nevada Health Authority (NVHA), this position provides day-to-day counsel to the NVHA
    in consultation with the Deputy Attorney General Office on solutions to regulatory requirements that impact various
    policies and programs and related compliance activities. Provide direct support to the Director and senior
    management team on any legal or regulatory issue.

    Support Division units by assessing and translating complex legislation, rules and regulations into understandable
    information and facilitating analysis of compliance and implementation implications, to include:
    - Review and/or draft policies and procedures and related documents.
    - Conduct training and preventative law activities.
    - Draft regulatory policies and procedure memos for the Department leadership
    - Developing strategies to integrate policies, procedures and programs with state, federal and community policies,
    procedures, and programs.
    The general counsel will consult with the Nevada Attorney General's office and advise Department leadership on
    regulatory matters related to compliance and complex federal rules and regulations regarding the operations of the
    agency. The general counsel will provide analysis and recommendations regarding the implementation of state and
    federal law with respect to the day-to-day operations of Medicaid, including Titles XIX and XXI of the Social Security
    Act, the Affordable Care Act, Americans with Disabilities Act, the Consolidated Appropriations Act of 2022, among
    other. The Centers for Medicare & Medicaid Services (CMS) issues guidance letters and memoranda to state Medicaid
    Directors on a near monthly basis clarifying and updating federal policy regarding CMS current interpretation of
    federal regulations. These changes impact all elements of the program and often have historical context and case
    law affecting the interpretation and application to the Medicaid program and potentially other areas of the
    Department. The NHA general counsel will provide the necessary subject matter expertise to review federal
    regulations impacting Medicaid as well as other Department programs and develop guidelines and procedures for
    risk management and ensuring the Authority is compliant with federal requirements.

    The NVHA general counsel will meet with staff from the CMS, representatives of other state agencies including the
    Governor's Office and Finance Office, Legislative Council Bureau, Attorney General's Office, and contracted vendors.
    In addition, the NVHA general counsel may be required to testify on program policies, division budget concepts, and
    fiscal notes during the Legislative Session, the Interim Finance Committee (IFC) meetings, and regulatory workshops
    and hearings.
    The NHA general counsel will serve as an expert subject matter resource to the Department for research and
    interpretation of specific healthcare policies and regulations.

    Qualifications:

    - Juris Doctor degree from an accredited law school
    - Current Nevada license and in good standing the State Bar of Nevada
    - Knowledge of Medicaid insurance, state insurance, and regulations.
    - Experience with health law preferred.
