Job Description and Duties

The Health Quality Enforcement Section (HQE) handles a broad range of compelling, rewarding and complex administrative matters on behalf of seven state health care licensing agencies in disciplinary actions filed against health care professionals, including physicians, surgeons and psychologists. Supervising Deputy Attorneys General (SDAGs) in HQE must have the ability and capability to handle the most complex, varied and difficult types of license applications, disciplinary actions, probation modification and termination cases, petitions for reinstatement of revoked licensees, and federal and state civil matters. SDAGs must also have the technical and organization ability and capability to supervise a team of attorneys and paralegals performing HQE Section duties which include, but are not limited to, the following:
Handling injunctive proceedings against physicians, psychologists, podiatrists and other allied health providers. Handling civil judicial review arising out of administrative litigation, civil subpoena enforcement actions, and interlocutory writs and appeals. Representation of state licensing agencies and/or their members or investigative staff in civil litigation matters which challenge the constitutionality of specific state statutes. Review reports of investigation documenting evidence collected by investigators working on behalf of client agencies in order to assess whether the evidence permits the Attorney General to advise client agencies whether disciplinary charges should be filed against licensees, additional evidence to properly make a legal determination should be obtained, whether complaints should be closed for lack of evidence, or other appropriate action should be taken. Rendering legal advice on an ongoing basis to client agencies and to the Attorney General. Handling administrative cases involving license discipline.
Under the general supervision of the Senior Assistant Attorney General, the Chief Assistant Attorney General, the Chief Deputy Attorney General, and the Attorney General, the SDAG is responsible for leading, inspiring, and ensuring that their team members are providing effective, efficient, and high-quality legal representation for our clients; communicating, collaborating and maintaining productive working relationships with peers, section management, clients, opposing counsel, and court officials; and conducting themselves in accordance with professional and government ethics requirements. The SDAG receives client referrals and assigns cases, works with DAGs to prepare and update litigation plans, consults as necessary on case strategy, meets with clients as necessary, reviews and edits all substantive written work of their team members, helps DAGs prepare for hearing and argument; recommends training and other types of professional advancement opportunities; and interviews and selects, or actively participates in the interview and selection process for SDAGs and DAGs.

Working in a collaborative and supportive team-based model, the SDAG directs, monitors, evaluates, and supervises the collective and individual performance of a 6 to 8 person team of HQE Deputy Attorneys General and paralegals. The SDAG works collaboratively and professionally with all members of the Section's management team, including Senior Legal Analysts and Associate Governmental Program Analysts. The SDAG also interacts with administrative client agency representatives as a leader in the section responsible for making critical decisions that apply prosecutorial discretion.

Candidates should have substantial litigation and appellate experience, excellent writing and editing skills; strong leadership skills; an interest in the professional development of others; and an interest in learning new areas of medicine, science, and law.

This is a hybrid position with the opportunity to work remotely or in the office on most days, but some regular required in-office attendance. Travel and additional in-person attendance may be required for court appearances, meetings, and other occasional operational needs.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

Civil or criminal litigation experience in a court of law within the prior six months. Ability to work under tight deadlines, public scrutiny, and pressure to produce high quality work in short timeframes. A demonstrated ability and experience in developing litigation plans, and in efficiently managing large caseloads. Excellent research and writing skills (exhibited by recent drafting of motions, complaints, petitions for injunctive relief, dispositive motions, and/or appellate briefs), as well as skill in oral advocacy and negotiations (exhibited by recent appearances in trial and appellate courts, and participation in settlement conferences). Well-organized and detail-oriented, a positive attitude, be team players, excellent work ethic and strong skills in interpersonal communication and collaboration. Highly motivated to work in the area of consumer protection, public safety and health care law on behalf of the Attorney General and the State. A demonstrated ability and experience in exercising excellent judgment.

A health care law background and knowledge of the administrative adjudication process pursuant to the Administrative Procedure Act, Government Code section 11400 et. seq are highly desirable. Experience in medical malpractice litigation, health care fraud, and/or criminal law is highly desirable. Ability to demonstrate excellent judgment and tact when interacting with clients, the public, opposing counsel and judges; show strong initiative in improving the work of the office; have strong organizational skills; excellent oral and written communication skills; effective work habits under pressure and scrutiny; an ability to work effectively with all levels of Attorney General staff; and creativity and resourcefulness in solving problems. Knowledge of bargaining unit MOUs, civil service laws and rules, and disciplinary process are highly desirable. The ability to manage and resolve conflicts, and relate well with members of the Section, the public and representatives of administrative agencies. Demonstrated leadership ability.
