Job Summary: Provides leadership in the administration of a comprehensive range of services, policies, and procedures related to equity and compliance. The Associate Director of Institutional Equity and Compliance participates in all aspects of institutional planning in support of the mission and goals of the university ensuring that all faculty, students and staff have the opportunity to succeed. The Associate Director assists and supports campus efforts related to diversity, equity and inclusivity as needed. In the absence of the Executive Director, serves as the primary University Chief Compliance Officer with oversight over campus compliance with Title IX, Discrimination/Harassment/Retaliation (DHR), Whistleblower, and the Americans with Disabilities Act (ADA). These programs are guided in the California State University (CSU) by CSU Executive Order 1095, Executive Order 1096, Executive Order 1097, Executive Order 1111, Executive Order 1115, Executive Order 1116, and CSU Conflict of Interest (COI). Major duties and responsibilities: Leadership & Incident Response Assist the Executive Director or serve in the absence of the Executive Director as the University official with ensuring campus compliance with state and federal Equity-related laws and related CSU executive order policies and procedures. Conduct intake meetings with complainants and respondents regarding sexual misconduct, discrimination, harassment, and retaliation; address immediate safety needs; communicate information about support services and facilitate contact with internal and external resources; communicate information about reporting options both on and off-campus and ensure parties' full understanding of the CSUSB investigation, resolution, and hearing procedures. Assisting with facilitating mediated agreements between affected parties. Assist in strategizing, developing, implementing, and evaluating restorative practice interventions, mediations, and facilitated agreements for alternative resolution agreements. Supervision & Technical Direction of IEC Staff Reviews and updates procedures for investigations, hearings, and alternative resolutions including communication with the external investigators, parties, communicates with other relevant personnel, documentation of work, and other procedures. Provide oversight and guidance to investigators assigned with responsibilities in resolving Equity complaints and work collaboratively with members of the campus community to promote informed and consistent communication about related CSU executive orders. Review information and recommendations from assigned investigators, working with the Office of General Counsel when appropriate, and issuing final dispositions on complaints to relevant parties. Manage Equity investigations presented by faculty, staff, students and applicable third parties including interviews of complainants, respondents, and material witnesses, and obtain/review documents and other relevant materials within CSU executive order timelines and processes. Assists with the tracking and monitoring of Title IX complaints and investigations to meet prescribed deadlines; develops complaint/respondent management checklists, protocols and procedures; and assists in the coordination, tracking, and monitoring of Title IX compliance training. Assists the Executive Director in reviewing, writing, and/or revising University policies, procedures, and reports. Monitoring and Reporting Assist in the maintenance of the institutional database for incident reports, investigation reports, notices, decisions and appeals to ensure complete incident case management records are maintained. Collect, maintain and analyze data, as appropriate to contribute to the annual Clery Report. Maintains current inventory of regulations and statutes relating to sex, gender-based violence including, but not limited to Title VII, Title IX, VAWA, Campus Save Act, Clery Act and any new legislation on the subject. Assist in preparing and submitting internal and external reports, including all federally mandated reports. Campus Outreach and Training Provides ongoing consultations and updates regarding Title IX requirements, compliance programs. Coordinates with the Labor and Relations Director or Faculty Affairs Provost Office on matters pertaining to staff and faculty, accordingly. Facilitates with the CARES Assistant Director on the advertisement of educational and supportive programming (i.e. workshops, panels, events, etc.) within the campus and/or the local community. Assists in the preparation and dissemination of educational materials, including brochures, posters, and web-based materials, to inform members of the campus community of Title IX rights and responsibilities. Work with internal and off-campus community partners to develop and present comprehensive training programs and workshops for students, faculty, and staff. Monitoring the compliance of all students, employees, contractors and volunteers required to complete the applicable campus mandated trainings including but not limited to the annual Title IX training, the DHR training, Mandated Reporter training and the Conflict-of-Interest training. Prepare and disseminate educational materials, including brochures, posters, and web-based materials that inform members of the campus community of their rights and responsibilities. Provide guidance in the coordination of training and communication efforts to ensure greater inclusivity. Minimum Qualifications: Required Education and Experience Equivalent to a Master’s Degree in a related field or Juris Doctorate and three years of related experience required.
